Terms of Use

These terms cover the Android app Film Recipes: Color Cards (package app.filmode.recipes), published by FightTech VN. Installing or using the app means you accept them; if you do not, uninstall it. Where these terms and your country's mandatory consumer law disagree, the law wins.

1. What the app is

Film Recipes keeps colour recipes (short lists of camera-style colour settings) as cards. It previews a recipe on a photo, applies it to photos you choose and saves the results as new pictures, and lets you share recipes as a card image with a QR code, a link or text. All image processing happens on your phone. There is no account and no cloud storage; the only online parts are Google Play, for purchases, and the anonymous usage and crash reports described in the Privacy Policy.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal or commercial work. You may not decompile, reverse engineer, redistribute, resell or republish the app or any part of it, or remove its notices, except where the law does not allow that restriction.

3. Free and Pro

The app is free to download, with no advertising and no watermark. Free use has no time limit and includes eight built-in recipes, up to five recipes of your own, up to five photos per batch at full resolution, sharing and adding recipes by QR code, link or text, and .cube import. Film Recipes Pro is optional. It adds the other eight built-in recipes, unlimited recipes of your own, up to 100 photos per batch and .cube export. It is sold through Google Play as a monthly subscription, a yearly subscription or a one-time lifetime purchase, at the price Google Play shows in the app for your country. If Google Play offers you a free trial, the app shows it, with its length, before you buy.

Payment, renewal, cancellation and refunds are handled by Google Play under the Google Play Terms of Service. A subscription renews automatically until you cancel it in the Google Play app under Payments & subscriptions; after cancelling, Pro stays on until the end of the period you paid for. A free trial becomes a paid subscription unless you cancel before it ends. The lifetime purchase does not renew and stays with the Google account that bought it. For a refund, use Google Play's refund process; if Google declines and you believe you are owed one, write to us with your Google Play order ID (it starts with GPA.) and we will look at it.

When Pro ends, the Pro features lock again. Recipes of your own that you already saved stay yours: you can still open, edit, apply and share every one of them, and adding a new one beyond five needs Pro again. Pictures you already made are not affected.

4. The built-in recipes and base tones

The built-in recipes, base tones and their names are our own work and are licensed to you for use inside the app, on your own photos. The pictures you make with them are yours to use for any purpose, commercial or not, with no credit required. You may share a built-in recipe's settings as a card, link or text, as the app lets you. You may not extract the app's colour data (its base tones or look-up tables) to sell or republish it, except the .cube files you export for your own editing with Pro, which you may use in any software but not sell or distribute as a pack.

The recipes describe camera-style settings, but Film Recipes is not affiliated with, or endorsed by, any camera or film maker, and it does not reproduce any maker's in-camera processing. A recipe written for a camera, pasted into the app, is read with the app's own base tones and may look different from that camera's pictures.

5. Recipes you make and share

Recipes you make are yours. A recipe card, QR code, link or text carries the recipe's settings, its name and, if you typed one, an author name; anyone who can see or open it can read those. You are responsible for what you put in a name or author field, and for where you share it. A recipe someone else shares with you comes from them, not from us, and we do not review it.

.cube files you import are your own responsibility: import only files you have the right to use. We do not review them.

6. The sample photos

The eight sample photos in the app are winners of Wiki Loves Earth, used under their authors' Creative Commons licences (CC BY-SA 4.0, and CC BY 4.0 for one). They belong to their authors, not to us; you will find each author and licence in the app under Settings → About → Photo credits. If you save or share a recipe card made on a sample photo, the card includes that photo and its credit line, and that licence applies to the photo on it: keep the credit when you pass it on. Photos you apply recipes to are always your own picks, never the samples.

7. Your photographs

Photographs you use with the app are yours. We claim no licence, ownership or interest in them, and we never receive them: the app never uploads a photo. You are responsible for the photos you edit and share, including the consent of the people in them and the rights to photos that are not your own.

8. Your recipes and files

Your own recipes, imported .cube files and settings are kept in the app's private storage on your phone. Uninstalling the app or clearing its storage deletes them. To keep a recipe safe, share it to yourself as a link or text. Pictures and cards you save go to Pictures/Film Recipes and stay there when the app is removed. The app keeps only the capture date and time from the original photo's metadata, not its location. Android's own backup may or may not include the app's data, depending on your device and settings, so do not rely on it. We cannot recover anything for you, because we never had it.

9. Devices and third-party services

Batch speed and the largest photo the app can process depend on your phone's memory and graphics chip, which vary by manufacturer. QR scanning relies on Google's code scanner in Google Play services, and purchases rely on Google Play. We do not control those services and do not warrant that any particular feature or photo size works on any particular device.

10. No warranty

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted or error-free, that a recipe will look the same on every device or in every other app, or that a picture will be saved in any given situation.

11. Limitation of liability

To the fullest extent the law allows, FightTech VN is not liable for any indirect, incidental, special or consequential damages, or for lost photographs, lost recipes, lost data or lost opportunities, arising from your use of the app. Nothing here limits liability that cannot be limited by law, and nothing here affects consumer rights you have under the law of your country that cannot be waived by agreement.

12. Changes and availability

We may update the app, change or remove features, or stop distributing it. Material changes to these terms will be posted on this page, with a new effective date, before they apply to a new release.

13. Privacy

The Privacy Policy forms part of these terms. In short: your photos never leave your phone, there is no account, and the only data sent anywhere is anonymous usage counts and crash reports, which you can switch off in Settings, and purchases through Google Play.

14. Governing law

These terms are governed by the laws of Vietnam, without regard to conflict-of-law rules, and the courts of Vietnam have jurisdiction, except where the mandatory law of your own country of residence gives you the right to bring proceedings there.
